Website Plan Terms

These terms cover FlashyPrint website plans (Starter, Growth and Premium) and any custom website work we quote. They are an agreement between you (the business buying the plan) and FlashyPrint Inc., 1317 Edgewater Drive, Orlando, FL 32804 ("FlashyPrint", "we", "us"). By buying a plan or approving a quote, you agree to these terms. Our store Terms of Service and cancellation policy also apply. If they conflict, these terms win for website plans.

1. What you get

Each plan includes the design and build of your website, hosting, the security certificate (SSL), fixes if something on the site breaks, and a monthly number of update requests. The pages and features of each plan are the ones shown on our website plans page when you bought it. Anything outside your plan, like extra pages, a redesign, an online store, custom features or apps, is quoted separately and only starts once you approve the quote.

2. Getting started and launch

  • We aim to launch your site about 7 days after we have everything we need from you: your business details, logo, photos and domain access if you already own a domain.
  • Timelines depend on you sending that material and answering our questions. Delays on your side move the launch date.
  • You review a preview before launch. We make reasonable adjustments within your plan until it's right. Starting over with a new design counts as extra work.
  • If we haven't received your material 30 days after purchase, we may launch a simple version with the information we have, and add more when you send it.
  • Your billing starts at checkout and isn't paused while we wait for your material.

3. Billing

  • Plans are billed monthly or yearly, starting the day you check out. They renew automatically on the same day each month or year, using the payment method you checked out with, until you cancel.
  • Prices don't include sales tax where it applies.
  • If we change the price of your plan, we'll email you at least 30 days before your next charge at the new price. You can cancel before then.
  • Failed payments. If a payment fails, we email you and try again. If it's still unpaid after 7 days, your site is paused until the payment goes through. If it's still unpaid after 30 days, we may cancel your plan and take the site down.

4. Cancelling

There's no contract. Cancel anytime from your customer account or by emailing info@flashyprint.com from the email address on your order. Cancelling stops all future charges. Your site stays online until the end of the month or year you already paid for, then goes offline.

5. Refunds

Changed your mind? If you cancel within 48 hours of your first checkout and we haven't sent you a preview yet, we refund your first payment in full.

After that, payments for website plans aren't refundable, including partial months and the unused part of a yearly plan, because your site is built and hosted from day one. This doesn't limit any refund rights you have under law. If you think we charged you by mistake, email us and we'll fix it. Please contact us before disputing a charge with your bank. If a valid charge is disputed, we may pause the site while the dispute is open.

6. Update requests

  • An update request is one change you send us, like new hours, new prices, a photo swap, a text change or a new section on a page you already have.
  • Starter includes 1 request a month, Growth 2 and Premium 4. Unused requests don't roll over.
  • Send requests with our update request form or by email. We usually complete them within 3 business days. Premium requests go first.
  • New pages, a redesign, new features or big content changes aren't update requests. We quote them first.

7. Who owns what

Your content. Your logo, photos, text and other material you send us stay yours. You give us permission to use them to build, host, maintain and back up your site. If you cancel, we'll send your content back to you on request within 30 days.

The website. The design, layout, code, templates and setup we create are part of the service and belong to FlashyPrint. While your plan is active, you have the right to use them for your site. They aren't transferred or exported when the plan ends.

Domains.

  • A domain you already own stays yours. You keep paying its renewal with your own registrar, and you give us the access we need to connect it.
  • A domain we register for you is registered in our account and owned by FlashyPrint. Its yearly renewal is included while your plan is active.
  • You can buy a domain we registered anytime your account is paid up, for a one-time domain transfer fee of $150. We then transfer it to you.
  • If your plan ends and you haven't bought the domain, we may keep it, let it expire or release it. We'll never use it to pose as your business or to send your customers to a competitor.

Our portfolio. We may show your site in our portfolio and link to it. Email us if you'd rather we didn't.

8. Your responsibilities

  • The information you give us is accurate, and you tell us when it changes.
  • You have the right to use everything you send us, including photos, logos, text and trademarks.
  • Your business, products, prices, claims, licenses and reviews shown on the site are your responsibility.
  • If your site needs legal pages (like a privacy policy), we can add a standard template, but you're responsible for its content and for following the laws that apply to your business.
  • You review your site before launch and tell us if anything is wrong.

9. What we don't allow

We don't build or host sites that are illegal, sexually explicit, hateful, deceptive, that infringe someone else's rights, or that spread spam or malware. We may refuse, pause or end a plan that breaks this rule.

10. Other companies' services

Your site may rely on other companies, like hosting providers, domain registrars, Google, maps, and ordering or booking tools (for example DoorDash, Uber Eats, Toast, Square, OpenTable or Booksy). You set up, own and pay for your own accounts with those services and send us the links we need; we add them to your site but don't create or manage those accounts. Their own terms apply to them. We aren't responsible for their outages, fees, changes or decisions. Business email is not included unless we agree to it in writing.

11. No guarantees

  • We set your site up so Google can read it, but no one can guarantee search rankings, traffic, calls or sales, and we don't.
  • We work to keep your site online and secure, but we can't promise it will never be down or never have a problem.
  • We build with common accessibility practices, like readable text, image descriptions and working keyboard navigation. We don't guarantee that your site meets the ADA, WCAG or any other accessibility law or standard.
  • We keep backups as part of normal hosting, but you should keep your own copies of your content.
  • Except as written in these terms, the service is provided "as is", without warranties of any kind, to the extent the law allows.

12. Limits on liability

To the extent the law allows, FlashyPrint isn't liable for indirect, incidental or consequential losses, including lost profits, lost sales, lost data or damage to reputation. Our total liability for any claim about the website service is limited to the amount you paid us for it in the 3 months before the claim.

13. Claims about your content

If someone makes a claim against FlashyPrint because of your content, your business or your breach of these terms, you agree to cover our reasonable costs, including legal fees.

14. If we end a plan

We may pause or end a plan if you break these terms, don't pay, or treat our team abusively. If we end a plan for any other reason, we'll give you at least 30 days' notice and refund any unused prepaid time.

15. Contact

Website plan support is by email and message, not by phone. Email info@flashyprint.com and include your business name. We send notices about your plan to the email address on your order.

16. Changes to these terms

We may update these terms. If a change is important, we'll email you at least 30 days before it applies to your plan. If you keep your plan after that, you accept the new terms.

17. Law and disputes

These terms are governed by the laws of the State of Florida. Before taking any legal action, contact us and give us 30 days to try to fix the problem. Any case goes to the state or federal courts in Orange County, Florida, except that either side can use small claims court. If one part of these terms can't be enforced, the rest still applies.
